This Agreement is made between He/Him Magazine (aka He/Him Zine) ("Publisher") and the undersigned individual ("Model"). By signing this Agreement, the Model agrees to the following terms and conditions regarding the submission and use of their image and likeness for publication and promotion by the Publisher.
1. Simple Grant of Rights
The Model grants the Publisher a worldwide, royalty-free, non-exclusive, perpetual license to use, reproduce, edit, publish, distribute, and display the submitted images (the "Images") in He/Him Magazine (aka He/Him Zine) and related promotional and/or marketing materials, in any format or media now known or hereafter devised.
2. Model’s Representations
The Model represents and warrants that:
a. The Images are original, self-taken photographs of the Model.
b. The Model is at least 18 years old and has the legal right to enter into this Agreement.
c. The Images do not infringe on the rights of any other person.
3. Consent to Publication
The Model consents to the use of their name, likeness, and any other identifying features as represented in the Images for publication in He/Him Magazine (aka He/Him Zine) and its related media.
4. Sole Use Clause
The Model's submitted images must remain exclusive to He/Him Magazine (aka He/Him Zine) and may not be sold or used for any other purpose, other than in the Model's own personal portfolios, approved cross-promotions and collaborations, and always credited or stamped "© He/Him Zine".
5. Compensation
The Model acknowledges and agrees that they are submitting the Images voluntarily and will not receive monetary compensation or any other form of payment for by the Publisher, unless otherwise agreed.
6. Editorial Discretion
The Publisher reserves the right to edit, crop or modify the Images as necessary for publication, as well as the right to decline publication of any images at its sole discretion.
7. Indemnification & Law
The Model agrees to indemnify and hold harmless the Publisher, its employees, and affiliates from and against any claims, liabilities, or expenses arising from the use of the Images or any breach of the Model’s representations and warranties under this Agreement. This Agreement shall be governed by and construed in accordance with local laws.
